STORE POLICY
1. Introduction
1.1. These terms and conditions (hereafter “T&C’s”) outline the rules and regulations for the use of Reine Atelier (Pty) Ltd (Reg No. [2025/555687/07] (hereafter “Reine Atelier”) website, located at www.reineatelier.shop (“Online Shop”). By accessing or using our Online Shop, you
agree to be bound by these T&C’s.
1.2. By making a payment on any invoice issued by Reine Atelier, the Customer acknowledgesand agrees to be bound by these T&C’s.
2. Order Placement
2.1. Each order is subject to Reine Atelier’s acceptance, and Reine Atelier reserves the right to limit or refuse any order for any reason, including but not limited to product availability, errors in the description or price of the product, or error in your order as aligned with the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”). This acceptance will be conveyed through an electronic confirmation, such as an email or on-screen confirmation.
2.2. It is the Customer's responsibility to provide accurate and complete information when placing an order. Additionally, the Customer must ensure that the order details are correct before finalising the purchase.
2.3. Reine Atelier will not be held liable for any errors in the information provided or for any issues arising from incorrect order placement.
3. Pricing and Payment
3.1. All prices are listed in South African Rand (ZAR) and are exclusive of associated shipping costs and inclusive of VAT.
3.2. Payment must be made in full at the time of ordering through the accepted payment methods provided on our website.
3.3. For EFT payments, please use your Order Number as the payment reference to avoid delays in processing and make payment within 48 hours. Orders will only be dispatched once the payment has cleared in our account. Please note that items will not be held beyond the 48-hour payment window. If payment is not received within this timeframe, the order will be automatically cancelled, and the items will be released back into stock.
3.4. In instances where international payments are required, it is incumbent upon the Customer to ensure timely remittance of funds, bearing in mind that all associated bank and/or transfer fees are the responsibility of the Customer.
3.5. Please note that prices are subject to change without notice; however, such changes will not affect orders that have already been accepted.
4. Shipping and Delivery
4.1. Shipping costs, if applicable, are calculated at checkout based on your location and the size/weight of your order. Both local and international shipping rates will be displayed during checkout.
4.2. International customers are responsible for any customs duties, taxes, or import fees imposed by their country. These charges are not included in our pricing and must be settled by the recipient upon delivery.
4.3. Orders are typically processed and dispatched within one to three (1–3) days after payment confirmation. For EFT payments, dispatch will only occur once the funds have cleared in our account.
4.4. Reine Atelier will not be liable for any delays in shipping due to the courier service or any other unforeseen circumstances.
5. Returns and Refunds
5.1. If you are not satisfied with your purchase, you may return the product within 7 (seven) days of receipt for a refund or exchange, provided the product is in its original condition and packaging. Items must be unused, unworn, and in their original condition, with all tags and packaging intact. For hygiene and quality assurance reasons, Reine Atelier do not accept returns or exchanges on items marked as final sale, custom-made, or personalised.
5.2. The buyer is responsible for return shipping and handling costs unless the product is
defective or incorrect.
6. Warranty
6.1. Claims for defects due to manufacturing faults must be submitted within 7 (seven) days of receipt of the goods, accompanied by photographic evidence and a description of the issue. Upon assessment, the seller may, at its sole discretion, offer a repair, replacement, or refund.
6.2. This warranty does not apply to damage resulting from misuse, negligence, normal wear and tear, failure to follow care instructions, or alterations made by the customer. Variations in custom-made or personalised items are not considered defects and are excluded from warranty coverage.
7. Limitation of Liability
7.1. Reine Atelier shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the purchase, use, or performance of the products.
7.2. Reine Atelier shall not be held responsible for any damages or losses resulting from the use of, or inability to use, the website, including but not limited to technical errors, service interruptions, website downtime, inaccuracies or omissions in product descriptions or pricing, unauthorised access to user data, or the transmission of viruses or other harmful components. The Online Shop is provided on an “as is” and “as available” basis, and no warranties are made regarding its continuous, uninterrupted, or error-free operation. Users acknowledge that they access and use the website at their own risk.
8. Personal Information Compliance
8.1. Reine Atelier acknowledges and respects the importance of protecting personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPI Act).
8.2. By providing your personal information to us, you consent to its collection, processing, and storage for the purposes of fulfilling your order, communicating with you about our products and services, and complying with legal obligations. Reine Atelier will not share your personal information with third parties unless required by law or with your explicit consent. You have the right to request access to, correction of, or deletion of your personal information held by us.
9. General
9.1. Neither party shall be held responsible for any failure to perform its obligations under this Agreement if such failure is due to events beyond its reasonable control, including but not limited to acts of God, fires, floods, strikes, labour disputes, war, terrorism, government regulations, or any other cause beyond the control of the parties. In the event of a force majeure event, the affected party shall promptly notify the other party of the circumstances and the anticipated impact on performance. The parties agree to make reasonable effort to mitigate the effects of the force majeure event and to resume performance under this Agreement as soon as practicable.
9.2. All content, including but not limited to text, images, logos, and designs, displayed on the Reine Atelier website and associated materials are the intellectual property of Reine Atelier and protected by copyright laws. Any unauthorised use, reproduction, or distribution of our intellectual property is strictly prohibited.
9.3. These T&C’s shall be governed by and construed in accordance with the laws of the Republic of South Africa.
9.4. If any provision of these T&C’s are found to be invalid, illegal, or unenforceable under any applicable law, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired in any way. The parties agree to negotiate in good faith to replace the invalid or unenforceable provision with a valid and enforceable provision that reflects the original intent of the parties.
